Constitution of Pakistan Amendment 23rd
In 2017, National Assembly of Pakistan amended the Constitution of Pakistan for 23rd time. Through this amendment Assembly created the military courts for the trial of terrorists. In 2015, National Assembly passed the 21st Amendment and created the military courts for the period of 2 years. The period of two years was expired on 6th January 2017 hence this 23rd Amendment was passed to re-establish the military courts for further two years till 6th January 2019. At the end of this period all the amendments will be expired/removed automatically.
Due to extraordinary situation and circumstances the military courts are established to expedite the disposal of certain offences related with terrorism, waging of war or insurrection against Pakistan and to prevent the acts of threatening the security of Pakistan by any terrorist group.
The amendment further stated that the said terrorist groups including any such terrorist fighting while misusing the name of religion or sect, captured or to be captured in combat with the Armed Forces. Basically this amendment changes the Article 175 of Constitution of Pakistan 1973.
